This agreement describes the terms and conditions for participation in the Bornbuddys affiliate program. In this agreement, the term “Affiliate” refers to you (the applicant). In this agreement, “Bornbuddys” refers to Bornopedia Media, with whom you are entering this agreement. By applying to the Bornbuddy affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.

Account Registration & Terms

You must provide your legal full name, a valid email address, and any other information requested in order to complete the sign up process for an Affiliate account (“account”)

You must be 18 years of age or older to join this Program.

Each account is for use by either a single legal entity (e.g. a company or a partnership) or an individual user. We do not permit you to share your user name and password with any other person nor with multiple users on a network. Responsibility for the security of any user names and passwords issued (including those of any Invitees) rests with you.

You may not use the Program for any illegal or unauthorized purpose. You must not, in the use of the Program, violate any laws in your jurisdiction (including but not limited to copyright laws).

Affiliate Programs

There are only one Affiliate programs with Bornopedia: one-time.

Referral Links & Promotion

Once you have signed up for the Program you will be provided with a URL link that must be used to identify you when placing a link from our site, email or other communications to the Bornbuddys website. It is your responsibility to ensure each such link is correctly formatted.

Commissions

For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.

If the Affiliate is on a one-time payment option, they will receive a commission for each new sales.

Payment

An Affiliate can request a payment when their balance reaches a minimum balance of  ₹.1000/-. Payments can be requested every 10 days. Payment processing can take up to 05 days from the request date. Payments will generally be paid out via Bank Transfer.

Refunds

In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

Usage and Obligations

Affiliates are permitted to use the Bornbuddy brand and marketing resources available in the site. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.

The Affiliate will never imply that they are acting on behalf of Bornbuddys and will never advertise Bornbuddys products directly. The Affiliate will never bid for advertisements that compete with Bornbuddys.

The Affiliate will never represent themselves, Bornbuddys or their relationship with Bornbuddys in a false or misleading way.

The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing Bornbuddys.

Term and Termination

Either party has the right to terminate the agreement immediately without prior notice.

If the Affiliate terminates the agreement, no further commissions from Bornbuddys will be paid for any past or future customer transactions.

If Bornbuddys chooses to terminate the agreement, any balance greater than unpaid balance will be paid to the affiliate within 15 days of termination.

Governing Law

This Agreement shall be governed, construed, and enforced in accordance with the laws of the Maharashtra, India, without regard to its conflict of laws rules.

Arbitration

All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the Maharashtra, India. An award of arbitration may be confirmed in a court of competent jurisdiction.

Modification

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.
